In Morocco, what a foreign investor may acquire depends less on the asset than on the structure it is acquired through. Three routes, three regimes.
Urban property and building plots inside the urban perimeter, registered with the ANCFCC. Direct acquisition, title held in your name.
Under Law 62-19, a Moroccan-law société anonyme or société en commandite par actions may acquire agricultural land without limitation, including where the capital is entirely foreign-held. The legal form is decisive: an SARL does not qualify.
Agricultural land becomes directly acquirable once an attestation de vocation non agricole has been obtained. An administrative route, not a formality.
Every transaction we advise on is structured within the framework of Moroccan commercial and property law. We work alongside notaries, licensed surveyors and the competent administrations — ANCFCC, the AVNA commission and the relevant Wilaya services — so that the legal route is defined before capital is committed, not after.
Morocco does not only allow foreign investment. Under the Investment Charter it co-finances it. Most investors never claim what they are entitled to, because the eligibility is read after the acquisition rather than before it.
Open to projects of at least 50 million MAD creating 50 stable jobs, or to projects creating more than 150 stable jobs with no minimum investment. Premiums are cumulative and capped at 30% of the eligible investment: 5–10% on employment and capital expenditure, 10% or 15% territorial depending on the province, 5% sectoral, and 3% each for gender approach, future professions, sustainable development and local integration.
Turnover between 1 and 200 million MAD, investment between 1 and 50 million, at least 1.5 stable jobs per million invested and at least 10% equity financing. Employment premium of 5%, 7% or 10% according to jobs created, 10% or 15% territorial, 10% sectoral. Same 30% cap.
A dedicated regime applies from 2 billion MAD.
Five-year corporate tax exemption for exporters and for companies established in industrial acceleration zones, followed by a reduced rate. VAT exemption on imported capital equipment during the first twenty-four months. Customs relief on production equipment.
The exchange regime guarantees the free transfer of net profits, of the proceeds of disposal or liquidation, and of interest on investment-related loans.
Eligibility is assessed case by case, and depends on how the acquisition is structured. That assessment belongs before the purchase, not after it.
